What Is a Domestic Violence Protection Order?

A Domestic Violence Protection Order (DVO) is a court order designed to protect a person from domestic or family violence.

A DVO can place conditions on another person to prevent behaviour such as:

  • Physical violence or threats of violence

  • Emotional or psychological abuse

  • Coercive or controlling behaviour

  • Stalking or intimidation

  • Financial abuse

  • Unwanted contact or communication

Depending on the circumstances, the Court may make a temporary order while the matter is being determined or a final order following a hearing.

Who Can Apply for a DVO?

If you are experiencing domestic or family violence from a current or former partner, family member or informal carer, you may apply to the Magistrates Court for a Protection Order. The person seeking protection is called the “aggrieved”, while the person the application is made against is called the “respondent”.

An application may also be made on your behalf by a police officer or an adult you have authorised, such as a lawyer, friend or family member. In some circumstances, a guardian or attorney may also apply for you. If there is an immediate risk of harm, a Temporary Protection Order may be sought while the application is being determined.
